The present privacy policy describes how we process your personal data that we collect or that is transmitted to us in the context of our crowdfunding campaign.

In the case of support by users of the platform https://www.startnext.com/, a separate contractual relationship (e.g. a donation, purchase, work or service contract), which is independent of the platform operator, arises between the respective Starter and Supporter. Insofar as you have provided personal data to the platform operator, the platform operator is entitled to transmit the respective required data to us so that the support contract can be concluded and the contractual obligations can be fulfilled.

Within the scope of our electronic data processing, we may sometimes commission service providers as processors (e.g. IT service providers), who could gain access to your personal data in the course of their activities, insofar as they require the data to perform their respective service. These service providers have been obligated by us to take sufficient technical and organizational measures to ensure the protection of your data in accordance with Art. 28 DSGVO. These service providers are not permitted to disclose your data (except in cases regulated by law).

For the fulfillment of this contract, we sometimes need to process your personal data.

The legal basis for this processing activity is therefore the fulfillment of a contract or contractual obligations pursuant to Art. 6 (1) lit. b DSGVO.

The purpose of processing is the execution of the support contract and the fulfillment of the related obligations.

  1. Duration of storage

Your personal data will be deleted by us as soon as the purpose of storage and processing ceases to apply, provided that there is no legal obligation for longer storage or there are still legal claims that can be asserted against us and require storage.

In certain cases, we must disclose certain data, such as the amount and origin of the support amounts, to public institutions (e.g. tax offices) on the basis of legal obligations. The legal basis for this is the legal obligation pursuant to Art. 6 para. 1 lit. c DSGVO.

Sometimes we also have to disclose certain data, such as the amount of support and the names of the supporters, to (public) funding agencies in order to prove compliance with funding requirements that are binding for us. The legal basis for this is our legitimate interest pursuant to Art. 6 (1) lit. f DSGVO to fulfill the requirements and receive funding for the project from the respective funding agency. In certain cases, this disclosure may also be required by law (Art. 6 (1) (c) DSGVO).

Please note: Unless supporters make an “anonymous” donation, the name of the respective supporting account is visible to the general public on the platform https://www.startnext.com/ when listing the supporters of the project.

If you have expressly consented to the processing of your personal data, the legal basis for your processing is the consent given in accordance with Art. 6 (1) a DSGVO.

If your personal data is processed by a scientifically active institution, Section 2f of the Federal Act on General Matters Pursuant to Art. 89 DSGVO and the Research Organization (Research Organization Act – FOG), Federal Law Gazette No. 341/1981 as amended, may be indicated as the legal basis for processing pursuant to Art. 6 (1) lit. c DSGVO.

In all other cases, the legal basis for this processing is the legitimate interest of the controller or a third party pursuant to Art. 6(1)(f) DSGVO. The legitimate interest here is the pursuit of scientific or statistical purposes as well as research purposes. Appropriate technical and organizational measures have been taken to ensure a level of protection appropriate to the risk. The data concerned is not particularly sensitive data within the meaning of Article 9 of the GDPR. In this respect, there are sufficiently suitable guarantees for your rights and freedoms.

In all other cases, your personal data will not be disclosed by us to third parties for their own purposes without your consent or without a legal basis.

The platform operator uses Google Analytics. We receive certain data from the platform operator regarding the use or traffic on our project page.

We receive access to anonymized usage statistics for our project page, including over time (number of visitors, impressions, referrers, searches via Google, number of endorsements, number of supporters, number of fans).

Your IP address is anonymized. Conclusions about your person are not possible for us.

The legal basis for the use of Google Analytics is the consent given by you in accordance with Art. 6 (1) lit. a DSGVO.

As a further legal basis for the processing of the data, our legitimate interest according to Art. 6 (1) lit. f DSGVO in the analysis and improvement of our project site must also be stated as the legal basis.

We use Google Analytics to analyze the use of our website and to be able to improve it if necessary. The statistics obtained enable us to improve our content in particular and make it more interesting for users.

You have the right to obtain information from us about all data concerning your person that is processed by us. Specifically, you can request information from us about the following:

  • The purposes for which the personal data are processed;
  • the categories of personal data which are processed;
  • the recipients or categories of recipients to whom the personal data concerning you have been or will be disclosed;
  • the planned duration of the storage of the personal data concerning you or, if concrete information on this is not possible, criteria for determining the storage period;
  • the existence of a right to rectification or erasure of the personal data concerning you, a right to restriction of processing by the controller or a right to object to such processing;
  • the existence of a right of appeal to a supervisory authority;
  • any available information on the origin of the data, if the personal data are not collected from the data subject;
  • the existence of automated decision-making, including profiling, pursuant to Article 22(1) and (4) of the GDPR and, at least in these cases, meaningful information about the logic involved and the scope and intended effects of such processing for the data subject.

You have the right to request information about whether personal data concerning you is transferred to a third country or to an international organization. In this context, you may request to be informed about the appropriate safeguards pursuant to Art. 46 DSGVO in connection with the transfer.

You may request that inaccurate or incomplete data be corrected or completed. You may, in certain circumstances, for example, if the accuracy of data is in dispute until the accuracy has been verified, request restriction of the processing of data to the effect that it may only be processed with your consent or for the establishment, exercise or defense of legal claims or for the protection of the rights of another natural or legal person, or for reasons of substantial public interest.

  1. Right to data portability

You may request that we send you – or, if technically feasible, a third party designated by you – a copy of your data in a structured, common and machine-readable format. In addition, you have the right to transfer this data to another controller without hindrance by the controller to whom the personal data was provided, provided that the processing is based on consent pursuant to Art. 6(1)(a) DSGVO or Art. 9(2)(a) DSGVO or on a contract pursuant to Art. 6(1)(b) DSGVO, and the processing is carried out with the help of automated processes.

In exercising this right, you also have the right to have the personal data relating to you transferred directly from us to another controller, insofar as this is technically feasible. Freedoms and rights of other persons must not be affected by this.

  1. Right to deletion

You have the right to have data deleted in certain circumstances, such as if it is not processed in accordance with data protection requirements.

If you have asserted the right to rectification, erasure or restriction of processing against us, we are obliged to notify all recipients to whom the personal data concerning you has been disclosed of this rectification or erasure of the data or restriction of processing, unless this proves impossible or involves a disproportionate effort.

You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you which is carried out on the basis of Article 6(1)(e) or (f) DSGVO; this also applies to profiling based on these provisions.

In this case, the controller will no longer process the personal data concerning you, unless it can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

  1. Right to revoke the declaration of consent under data protection law.

You have the right to revoke your declaration of consent under data protection law at any time.

The revocation of the consent does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.

It is possible to lodge a complaint with the national supervisory authority of your place of residence if unlawful processing of personal data is assumed.
